I think we should wait until it is determined he is guilty before we start to consider the sentencing phase.

Something isn’t right with this.  My gut is telling me this is wrong.

Yes, rape is horrible assault on another human being, but the DEATH SENTENCE? Geez… get some perspective!

Ought to wait for the trial first, don’t ya think?

Rape can be found as a capital offense.

First-degree murder; felony murder; capital drug trafficking; capital sexual battery.

I’ve never heard anyone getting the death sentence for rape. Regardless of age.

And half the time, they don’t get the death sentence for murder.

Sure wish the victim could remember the details of what happened. Hopefully given time, she will.

Would like to hear what the accused has to say as well.

On the 6 O’clock news, the Sheriffs Dept. said they had DNA evidence that links the accused to not only this crime, but perhaps others as well. They must have had pretty good evidence for the judge to deny bail. Death sentence? I agree with the last post—I never heard of anyone getting death for rape; if she dies, well…

The fact that there is a possibility of the victim dying suggests attempted murder in the commission of a felony which merits the death penalty. It will be interesting to find out what evidence they have. Are there any cameras in the area?

It’s hard to imagine that someone could beat up another person so badly and have no scratches or marks, as his mother said (assuming she’s telling the truth.)

Two men sit on death row for rape, both in Louisiana, both black and both convicted of rape of a child.  One of the men under the death sentence had his case argued this month before the Supreme Court.  A decision is expected in June 2008.  Wikipedia Entry

In this case, the Bloomingdale rape, it is my understanding that the victim turned 18 a short time ago.  If this is the case, she is an adult in the eyes of the law, and the death penalty is off the table. The Supreme Court ruled in 1977 (Coker v. Georgia) that a state can not execute a man who rapes an adult woman.

Think she is telling the truth now? Maybe you’re right, she probably made all of it up.

It was hard to imagine that OJ Simpson could slaughter two people and come away without a scratch either.
